Texas Department of Public Safety Grants Hours Waiver for Propane

At the request of the Texas Propane Gas Association (TPGA), the Texas Department of Public Safety (DPS) has declared a local emergency, justifying certain exemptions from Parts 390 through 399 of Title 49 (Federal Motor Carrier Safety Regulations). The emergency declaration is in response to inclement weather hitting Texas, bringing ice, snow, and heavy rainfall.


This emergency declaration provides relief from Title 49, CFR, Part 395.3 hours of service restrictions outlined in the Federal Motor Carrier Safety Regulations for motor carriers providing direct assistance to the delivery of propane and home heating oil to storage facilities and homes in Texas.


Consistent with Title 49, CFR, Part 390.23, the emergency declaration will take effect at 12:01 a.m., January 10, 2025, and will remain in effect for the duration of the emergency (as defined in Title 49, CFR, Part 390.5) or for five days, ending at 11:59 p.m., January 15, 2025, whichever is less.


Download, print, and place the linked waiver in all propane delivery vehicles to comply with the exemption requirements.
